And 3 Others Counsel for Petitioner :- Pramod Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Vinod Diwakar,J. 1. In compliance of the order of dated 19.02.2025, Petitioner No.1- Smt. Karuna, Petitioner No.2-Anit Kumar and Respondent No.5- Rahul Kumar, are present before this Court, who have been identified by their respective counsels. 2. The instructions, handed over by the learned Standing Counsel for the State-respondents, have been duly taken on record. 3. The petitioners have filed the instant petition seeking protection from the police as they have solemnized marriage against the wishes of their parents. 4. Learned Standing Counsel, on the basis of instructions, states that on police verification it's revealed that Petitioner No.1-Smt. Karuna has already married to Respondent No.5-Rahul Kumar son of Shiv Lal Singh, resident of Village Prithvipur Khurd, Majra Sarai, District Amroha and from their wedlock a female baby was born, namely, Kittu, therefore, in such circumstances, the Petitioner No.1-Smt. Karuna, has no legal right to perform second marriage with Petitioner No.2-Anit Kumar, without obtaining a decree of divorce from the competent Civil Court. 5. The petitioner No.1-Smt. Karuna is present before this Court and stated as under: "आववेदक ससंख्यय-1 नवे न्ययययलय कवे समक्ष यह कथन ककयय कक उसवे ककोई जयनकयररी नहहीं थरी कक वररमयन पयथरनयपत/ययकचिकय कवे असंदर क्यय ललखय हहै उसनवे लसरर हस्रयक्षर ककयय थय रथय वह अपनवे पकर (पकरवयदरी ससंख्यय-5- रयहहल कक मयर) कवे सयथ जयनय चियहररी हहै, बशरर उसकय पकर उसवे ठरीक सवे रखवे।" 6. Respondent No.5-Rahul Kumar is also present before this Court and stated as under: "पकरवयदरी ससंख्यय-5 नवे न्ययययलय कवे समक्ष यह कथन ककयय कक वह यहयहाँ सवे अपनरी पत्नरी (आववेदक ससंख्यय-1-शरीमररी करुणय) कको अपनवे सयथ घर लवे जयनय चियहरय हहै और अपनवे बरीवरी- बच्चिचों कवे सयथ खकश रहनय चियहरय हहै रथय उससवे आगवे ककोई गलररी नहहीं हकोगरी रथय भकवष्य मम वह अपनरी पत्नरी और बच्चिचों कको खकश रखवेगय।" 7. In the above statements, the respondent no.5-Rahul Kumar, undertakes to keep the Petitioner No.1-Smt. Karuna with him and further agreed to provide her love and affection as they have performed their marriage on 04.03.2022 according to Hindu Rites and Rituals, therefore, in the present scenario, the relief sought in the present writ petition cannot be granted. 8. Accordingly, the writ petition is dismissed. 9. The personal appearance of Petitioner No.1-Smt. Karuna, Petitioner No.2-Anit Kumar and Respondent No.5-Rahul Kumar, is exempted unless otherwise specifically called in some case.
