This application has been filed by the applicants seeking substitution of the legal heirs of the writ petitioner, namely, Chanakya Sutradhar, who expired during the pendency of the writ petition being WP(C) No.4504/2021. It is submitted that right survives as the claims of the deceased petitioner pertains to his entitlement to pension. Learned Standing Counsel as well as learned Government Advocate, Assam for the respondents do not object to the prayer made. Accordingly, Interlocutory Application stands allowed. Pakhila Sutradhar, wife of late Chanakya Sutradhar, and other legal heirs of late Chanakya Sutradhar, as reflected in the Next of Kin certificate dated 01.04.2024 (Annexure B to the Interlocutory Application), be substituted as the legal heirs of the writ petitioner, namely, late Chanakya Sutradhar.
