STATE OF PUNJAB …RESPONDENT Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Sandeep Arora, Advocate for the petitioner. Mr. Ravneet Singh Joshi, Deputy, A.G., Punjab. Mr. G.S. Ghuman, Advocate for the complainant. *** N.S.Shekhawat J. (Oral) 1. The petitioner has filed the present petition under Section 483 BNSS with a prayer to grant regular bail to him in case FIR No.203 dated 19.12.2021, registered under Sections 326, 325, 323, 324, 427, 148, 149, 120-B IPC and Section 307 IPC added later on, Police Station Mahilpur, District Hoshiarpur. 2. While granting the concession of interim bail on 18.03.2025, this Court had noticed the following contentions:- “Learned counsel for the petitioner contends that the petitioner was not named in the FIR and has been arrayed as an accused in the present case due to political enmity between the VIPIN KUMAR 2025.07.25 17:38 I attest to the accuracy and integrity of this judgment/order CRM-M-61321-2024 -2- parties. Even otherwise, no specific role/injury has been attributed to the petitioner and he was not present at the place of occurrence. Even, the case was examined by five officials during the course of investigation and the petitioner was found innocent in four such inquiries. The petitioner was arrested on 07.08.2024 and is in custody for the last more than 06 months. The challan has been presented against the petitioner, however, no witness has been examined so far”. 3. Learned counsel for the petitioner has reiterated the submissions again and submits that after the grant of concession of interim bail, the petitioner has not misused the concession of bail in any manner. He further contends that another similarly placed co-accused Parminder Singh has also been granted the concession of bail by this Court, vide order dated 09.04.2025 passed in CRM-M-18565-2025. 4. On the other hand, learned State counsel assisted by learned counsel for the complainant have vehemently opposed the submissions made by learned counsel for the petitioner on the ground that the petitioner was also one of the main accused and has caused injuries to the injured. Learned State counsel further submits that in the present case, a lookout circular has already been issued against Harjinder Singh, accused but every attempt made has been failed to arrest him. Further, the two more accused have also been arrested in the present case and the investigation shall be conducted expeditiously. He has also filed status report by way of an affidavit of the Senior Superintendent of Police, District Hoshiarpur on behalf of the respondent-State and the same is taken on record. As per status report, Setion 427 IPC has been deleted and Section 201 IPC has been added during further investigation. In the present case, it is not disputed that the Parvinder Singh, injured has already been discharged from the hospital and is hale and hearty. Even the petitioner has suffered custody for almost 01 year and challan has been presented against him. Moreover, another similarly placed co-accused namely Parminder Singh has been granted the concession of bail. 7. Without commenting on the merits of the case, the present petition is allowed and interim bail granted to the petitioner vide order dated 18.03.2025 is made absolute. 24.07.2025 (N.S.
