Mr. Karunqasish Chakraborty.
… … for the Petitioners
Mr. Bidyut Kr. Ray, Mr. Sobham Gani.
… … for the State
1. Heard the learned Advocates for the parties.
2. We have considered the materials on record. Petitioner No.1 is the husband and petitioner Nos.2 and 3 are the parents- in-law of the victim lady. Allegations against them are general and omnibus. Allegation for forcible abortion is not supported by medical evidence.
3. Under such circumstances we are inclined to grant bail to the petitioners subject to conditions.
4. Accordingly, we direct that in the event of arrest, the petitioners viz., 1) Prosenjit Maity, 2) Mrs. Krishna Maity and 3) Mr. Sukumar Maity be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the BNSS and on further condition petitioner No.1 while on bail shall meet the Investigating Officer once in a week until further orders. They
2 shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
5. The application for anticipatory bail is, thus, disposed of.
