The instant application under Section 482 Cr.P.C. has been filed seeking a direction to the learned court below to decide the Complaint Case No. 15 of 2017 (Savitri Singh vs. Mohammad Islam and others) under Sections 406, 420, 467, 468, 504 and 506 IPC, P.S. Phoolpur, District Allahabad, pending in the Court of Additional Chief Judicial Magistrate, Court No.7, Allahabad, expeditiously. 3. Looking at the nature of prayer, learned AGA raised a preliminary objection that the application under Section 482 Cr.P.C. is not maintainable as specific remedy is provided under Section 483 Cr.P.C. 4. In view thereof, learned counsel for the applicant seeks to withdraw the instant application with liberty to file appropriate application. 5. Accordingly, the instant application is dismissed as withdrawn. 6. Certified copy of the documents shall be returned to learned counsel for the applicant by retaining the photocopy thereof.
