Hon'ble Vikram D. Chauhan,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The present writ petition is filed with the following prayer: "i. Issue a writ order or direction in the nature of certiorari quashing the impugned order dated 28.09.2024 passed by court of District Magistrate, Mandal Basti, District Basti in Case No. 00159 of 2009 (State vs. Hanuman Yadav) bearing computer case no.D-202117650000159 under Section 17(3) of Arms Act." 3. It is submitted by learned counsel for the petitioner that arms licence of the petitioner has been cancelled. 4. Learned Standing Counsel submits that against the impugned order, petitioner has a remedy of filing appeal. 5. At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the present writ petition with liberty to file appeal against the impugned order. 6. The writ petition is, accordingly, dismissed as withdrawn with liberty to the petitioner to file appeal within thirty days from today. In the event, such an appeal is filed within the said period, it is expected that the same shall be considered and decided on merits without going in to the question of limitation.
