Mr. Shailendra Singh Chauhan, learned D.A.G. with Mr. Vikas Uniyal, learned Brief Holder for the State of Uttarakhand/ respondent Nos.1 & 2. 3. By means of the present criminal writ petition, petitioners have challenged the FIR No.314 of 2021 dated 13.10.2021 registered with P.S. I.T.I., District Udham Singh Nagar, under Sections 323, 504, 506 of IPC. 4. It is informed by the learned State Counsel that after investigation, charge-sheet has already been submitted by the police on 27.11.2021 against the petitioners, therefore, nothing remains to be decided in this writ petition and it becomes infructuous. 5. Learned counsel appearing for the petitioners has not disputed the said fact. 6. In view of the above, the present criminal writ petition is dismissed as infructuous. However, it is open to petitioners to challenge the charge-sheet in appropriate proceedings, before the appropriate forum. 7. Interim order dated 29.10.2021 stands vacated.
