Hon’ble Shri Justice Ravindra Kumar Agrawal Judgment on Board 06.03.2025
1. This is the second bail application of the applicant. Vide order dated 12.06.2024, passed in MCRC No. 3012 of 2024, the first bail application of the applicant has been dismissed as withdrawn. While dismissing the first bail application, no liberty was granted in favour of the applicant. Hence, the second bail application.
2. Learned counsel for the applicant would submit that out of total 24 witnesses, 10 witnesses have been examined till 06.12.2024 and there are many
2 omission and contradiction in the evidence of the material witnesses as well as in the evidence of the other witnesses. There is no Shalimar railway station near Nagpur railway station and therefore, the allegation levelled against the applicant is completely false. The applicant is in jail since 12.09.2023 and looking to the detention period of the applicant and possibility of delay in final adjudication of the case, the applicant has filed this second bail application.
3. On the other hand, learned State counsel opposes the bail application.
4. Considering the submissions made by the learned counsel for the parties particularly considering the fact that while dismissing the first bail application no liberty was granted to the applicant. Merely examination of the some of the witnesses does not amount to change in circumstances particularly when the trial of the case is in progress, therefore, I do not find any good ground to admit this second bail application of the applicant.
5. Accordingly, the present second bail application of the applicant is dismissed at the motion hearing stage.
