Neutral Citation No. - 2025:AHC:114186 Court No. - 34 Case :- WRIT - C No. - 37564 of 2024 Petitioner :- Paramjeet Singh Respondent :- State Of UP And 3 Others Counsel for Petitioner :- Ashish Kumar Ojha,Satya Prakash Rai Counsel for Respondent :- C.S.C.,Raj Kumar Dhama Hon'ble Rohit Ranjan Agarwal,J. A preliminary objection has been raised as to the maintainability of the writ petition on the ground that the order passed on 08.10.2024 is on the restoration application, against which, a revision lies under Section 210 of U.P. Revenue Code, 2006. Moreover, the partition suit under Section 116 of the U.P. Revenue Code, 2006 is still pending consideration. Learned counsel appearing for private respondents submits that a direction may be issued for the expeditious disposal of the partition suit. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondent, the matter is being disposed of with a direction upon authority concerned to decide the partition suit filed under Section 116 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. However, in case the petitioner is aggrieved by the order restoring the case, he has a remedy of filing revision. With the aforesaid observations, present writ petition stands
disposed of.
