[2025:RJ-JP:10376] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3508/2025 Balram Mahnta S/o Beerendra Nath, Aged About 35 Years, R/o Gram Konamali Thana Kotwali, District Kunch Bihari, Paschim Bengal Hal Kiraydar Plot No.- 170 D Block, Hanuman Nagar, Vaishali Nagar, Police Thana Vaishali Nagar, Jaipur (Presently Confined In Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Ms. Vaishnavi For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 07/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 79/2025 registered at Police Station Shiprapath, District Jaipur City (South) for the offence(s) under Section 8/20 of the NDPS Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the recovered quantity of contraband articles containing ganja is 10.340KG, which is below commercial quantity. The accused-petitioner is in custody since 03.02.2025 and the trial/investigation of the case will take considerable time. There are no criminal antecedents against the petitioner. It is also contended that similarly situated co-accused has already been [2025:RJ-JP:10376] (2 of 2) [CRLMB-3508/2025] enlarged on bail vide order dated 25.02.2025, therefore, the benefit of grant of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the grant of bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that accused-petitioner is in custody since 03.02.2025 and the trial/investigation of the case will take considerable time. There are no criminal antecedents against the petitioner and similarly situated co-accused has already been enlarged on bail, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Balram Mahnta S/o Beerendra Nath, in connection with FIR No. 79/2025 registered at Police Station Shiprapath, District Jaipur City (South) shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing as and when called upon to do so.
