Applicant-Accused has filed this application under Section 407 Cr.P.C. seeking transfer of Misc. Case No. 1380 of 2018, titled Sunil Vs. Arun and others, arising out of Case Crime No. 917 of 2018, under Sections 304, 504 I.P.C., Police Station Baghpat, District Baghpat, pending before the Civil Judge (J.D.), Baghpat to the court of competent jurisdiction at Muzaffar Nagar. Learned counsel for applicant prays for transfer of the subject case on the ground that the applicant-accused is residing at Muzaffar Nagar, and it is difficult for her to travel 100 kilometers to attend the trial proceedings. Learned counsel submits that the complainant is also resident of Muzaffar Nagar, therefore, the case be transferred from Baghpat to Muzaffar Nagar. The sole ground of convenience raised by accused for transfer of the case is not sufficient. The application fails and is hereby dismissed.
