(Oral) The applicant is in judicial custody in FIR/Case Crime No.321 of 2023, dated 11.09.2023, under Sections 302, 396, 412, 201, 34 IPC, Police Station Kankhal, District Haridwar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. It is argued that the co-accused having even graver role has already been granted bail. 4. Learned State Counsel would submit that the recovery of mobile of the deceased was made from the applicant. 2 5. On being asked, learned State Counsel submits that from the co-accused, who have already been granted bail, recovery of weapons of offence and other articles were made. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
