Applicant-Suraj Goswami, who is a charge sheeted accused has approached this Court by means of present application under Section 482 Cr.P.C. challenging the order dated 12.7.2024 passed by Additional Sessions Judge, (F.T.C.-I), Mau in Sessions Trial No. 757 of 2022 (State of Uttar Pradesh Vs. Suraj Goswami and others) arising out of Case Crime No. 269 of 2022, under Sections 34, 147, 148, 302 I.P.C., Police Station Haldharpur, District Mau, whereby the application dated 28.05.2024 under Section 311 Cr.P.C. filed by accused applicant has been rejected. 4. At the very outset, the learned counsel for applicant submits that serious mistakes have occurred in the present application. He therefore submits that in the interest of justice applicant be permitted to withdraw the present application with liberty to file fresh. 5. Prayer made by the learned counsel for applicant is bona fide. Same is not opposed by the learned A.G.A. or the learned counsel representing first informant. 6. In view of above, this application is accordingly dismissed as withdrawn with liberty to file fresh. 7. Certified copies of documents appended along with this application shall be returned to the learned counsel for applicant after obtaining photocopies of the same to be kept on record.
