Court No. - 4 Case :- WRIT - A No. - 1173 of 2025 Petitioner :- Smt. Krishna Devi Respondent :- Union Of India And Another Counsel for Petitioner :- Manish Kumar Singh Counsel for Respondent :- A.S.G.I.,Prem Narayan Rai Hon'ble Ajit Kumar,J. Heard Sri M.K.Singh, learned counsel for the petitioner and Sri P.N.Rai,
learned counsel for the contesting respondent. By means of present petition, petitioner has prayed for a writ of mandamus commanding respondent no. 2 to pass appropriate order on letter dated
18.12.213. Learned Standing Counsel has obtained instructions in the matter and place the same before this Court, which are taken on record. As per instructions, petitioner's candidature was considered, but was not found fit to be placed in the merit list and hence it cannot be said that petitioner's claim for compassionate appointment has remained unconsidered. However, he submits that petitioner had given opportunity to apply again but till date petitioner has not applied.. Paragraph 3 of the instructions is reproduced hereunder :
"It is submitted that recruitment process for compassionate appointment is conducted only on availability of vacancy. The prospective candidates are screened by a Board of Officers and the applications are then sent to Superior Headquarters. Thereafter, a merit list is generated. From the documents annexed by the petitioner to the subject WP, it is clear that the petitioner was duly considered but did not make it in the merit list (Annx 4 at the page 19 refers). She was also asked to submit afresh, if required. Therefore, here contention of not being considered for compassionate appointment is grossly misplaced." In view of above, since petitioner has not applied even after being afforded opportunity and the fact that petitioner's candidature has been previously considered and rejected, which order is not challenged, I do not grant indulgence in the matter. Petition fails and is accordingly rejected.
