This writ petition has been filed seeking following relief :- "issue a writ, order or direction in the nature of the MANDAMUS commanding and directing respondent authorities to declare the petitioners as Bhumidhar over the allotted land under the provisions of Section 76 (1) (Gh) (Gh) of U.P. Revenue Code, 2006 and Rule 83 of the U.P. Revenue Code Rules, 2016 by declaring the petitioners non-as Bhumidhars providing transferable rights by disposing of the application pending before him filed by petitioners.." 3. Contention of learned counsel for the petitioners is that petitioners are entitled for the benefit of Section 76(1)(dd) of the U.P. Revenue Code, 2006 read with Rule 83. Petitioners have approached respondent No.3 by means of an application dated 12.9.2024 which is pending consideration. 4. Learned Standing Counsel has submitted that no useful purpose would be served in keeping this writ petition pending and a direction may be issued to respondent No.3 to decide the above-mentioned application in a time frame as fix by this Court. 5. In view of the same, this writ petition stands disposed of with a direction to respondent No.3 to decide the above-mentioned application filed by the petitioners, in accordance with law, expeditiously, preferably within three months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
