Neutral Citation No. - 2025:AHC:129005 Court No. - 34 Case :- WRIT - C No. - 37511 of 2024 Petitioner :- Draupadi Devi Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Udai Shankar Chauhan Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:- "i. Issue a writ, order or direction in nature of MANDAMUS commanding and directing the Sub Divisional Officer, Tehsil-Kasimabad, District-Ghazipur (respondent no. 3) to not demarcate the plot no. 325min, and 326min. situated in Village-Uchauri, Pargana-Jahoorabad, Tehsil-Kasimabad, District Ghazipur, without partition/division in view of order dated 18.06.2022 passed in Case no. 1747 of 2022 (Computerized Case no. T202214291101747) (Behafu Vs. Gaon Sabha) under section 24 U.P. Revenue Code 2006." Petitioner, before this Court, is aggrieved by action of private respondents. He had initially instituted proceedings under Section 24 of U.P. Revenue Code, 2006 which was dismissed on 18.06.2022 on the ground that suit for division lies under Section 116 of U.P. Revenue Code, 2006. The petitioner has neither challenged the order passed under Section 24 of the Code in proceedings under Section 24(4) of U.P. Revenue Code, 2006 nor has instituted a suit for division of partition under Section 116 of U.P. Revenue Code, 2006. The relief claimed in the writ petition cannot be granted. The writ petition is misconceived and stands dismissed. Order Date :- 1.8.2025 V.S.Singh Digitally signed by :- VIDYA SAGAR SINGH High Court of Judicature at Allahabad
