Miscellaneous Application (IA No. 3493/2022) has been filed by the appellant from jail through the Jail Superintendent, Almora, stating that he has served the sentence awarded to him and therefore does not wish to pursue the criminal jail appeal. 5. The Co-ordinate Bench of this Court, vide its order dated 10.09.2024, directed the learned State Counsel to seek instructions regarding whether the sentence imposed by the learned trial court has been served by the appellant or not. 6. Today, the learned State Counsel has supplied instructions to the Court, which are taken on record. On instructions, she submits that the appellant has already served the sentence passed by the learned trial court in Special Sessions Trial No. 03 of 2017, State vs. Deepak Kumar & Others, under Sections 366A, 376 IPC, and Sections 3/4 & 16/17 of the Protection of Children from Sexual Offences Act, 2012, vide judgment and order dated 20/21.06.2017. 7.
