2025:JHHC:12300 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2384 of 2025 Bimali Devi, wife of Chandu Choudhary, resident of village Nimiyakhar, P.O and P.S. Dandai, District- Garhwa, Jharkhand. ..... Petitioner(s). Versus The State of Jharkhand … Opp. P arty(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Md. Sajid Yunus, Advocate. For the State : Mr. Sardhu Mahto, A.P.P …..... 07/24.04.2025 This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 126(2), 115(2), 132, 352, 351(2), 351(3), 3(5) of BNS in connection with Dandai P.S. Case No. 08 of 2025, pending in the Court of learned JM, 1st Class, Garhwa. Heard learned counsel for the petitioner(s) and learned APP for the State at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. The petitioner is a lady. Her son was rebuked in the school i.e. why the petitioner went there and an altercation had taken place with the teacher in the school. During course of argument, learned counsel for the State submits that notice under Section 35(3) BNS was issued and the petitioner has appeared and has given the reply to the same, thus she has co-operated in the investigation. There is nothing in the petition to suggest that the petitioner is apprehending arrest in this case. Thus, I am not inclined to entertain this application. The petitioner is directed to surrender before the Trial Court and seek regular bail which shall be considered by the said Court strictly in compliance of the guidelines laid down in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another, reported in (2022) 10 SCC 51 as well as the observation made in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another reported in (2024) 9 SCC 198. Accordingly, this application stands disposed of. Anu/-C.P.-3 (ANANDA SEN, J.)
