Applicant-Complainant-Brij Mohan Gupta has filed this petition under Section 407 Code of Criminal Procedure for transfer of Misc. Case No. 3628 of 2019; titled Brij Mohan Gupta vs. State of U.P. and others, under Sections 147, 323, 452, 504, 506, 307 IPC pending before Special Chief Judicial Magistrate, Agra to the court of competent jurisdiction at any other district. The complainant-applicant has prayed for transfer of the above criminal trial to some other court of competent jurisdiction in any other district court, as the accused-opposite party no. 2 is a practicing lawyer, who alongtwith his associates is threatening the complainant. The complainant-applicant has appended the application moved before the Agra Bar Association and a perusal of the same would show that he has levelled all kinds of allegations against the opposite party no. 2 and also questioned his qualifications. Except for the bald averments, there is no other supportive material produced before the Court, therefore, no ground is made out for transfer of the case.
