The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to modify the judgment and order dated 23.05.2024 passed by Additional Principal Judge Family Court No. 1, Agra, in restoration application being Case No. 401 of 2023 arising out of an application under Section 126(2) of Cr.P.C., by which judgment dated 18.06.2022 has been set-aside and opposite party no. 2 is directed to pay 50% of total maintenance amount within two months. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ revision/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
