Neutral Citation No. - 2025:AHC:6534 Court No. - 49 Case :- WRIT - B No. - 4294 of 2024 Petitioner :- Dhanwanti Devi Respondent :- Deputy Director Of Consolidation And 6 Others Counsel for Petitioner :- Agnivesh,Jadu Nandan Yadav Counsel for Respondent :- C.S.C.,Hari Narayan Singh,Sushant Misra Hon'ble J.J. Munir,J. Heard Mr. J.N. Yadav, learned Counsel for the petitioner, Mr. Sushant Misra, learned Counsel appearing on behalf of respondent no. 4, Mr. Hari Narayan Singh, learned Counsel appearing for the Gaon Sabha and Mr. Sanjay Kumar Ray, learned Standing Counsel. The petitioner lays challenge to the order of the Deputy Director of Consolidation dated 18.09.2024 by which learned Counsel for the petitioner says that she has been deprived of her original holding. It is appears that the original holding of the petitioner comprised of three plots being nos. 33/2 admeasuring 0.154 hectares, 353/3 admeasuring 0.214 hectares and 347 minjumla admeasuring 0.368 to the extent of a half share. Much of this original holding went out of the petitioner's chak before the authorities below through orders that are not under challenge. There is a case of compromise done before the Settlement Officer of Consolidation with one Sanjiv Kumar in terms of which, in the year 2004, the petitioner exchanged her original holding for plot no. 348, besides plot no. 126 as appears from the memorandum of compromise filed in Appeal No. 541/257 of 2004. It is not disputed that Sanjiv Kumar had sold away his holdings prior to the year 2004. The Deputy Director of
Consolidation has, therefore, held that Sanjiv Kumar had no share left in the holdings that he could compromise with the petitioner, Dhanwanti Devi in the year 2004. Now, as matter stands, none of the original holdings of the petitioner Dhanwanti Devi have been taken out of her chak by the order of the Deputy Director of Consolidation impugned. The chief and only contention of the petitioner that she has been deprived of all her original holding, therefore, fails. No other point was pressed. This petition fails and is summarily dismissed.
