The appellant has filed this appeal against the judgment dated 04.01.2023 passed in Civil Suit No. 16/2019 by the learned Judge, Family Court, Balod, District – Balod, Chhattisgarh, KISHORE KUMAR DESHMUKH Digitally signed by KISHORE KUMAR DESHMUKH Date: 2025.01.22 13:20:58 +0530 whereby the learned Family Court has rejected the application of the appellant filed under Section 10 of the Guardian and Wards Act, 1890 seeking custody of his child Bhupesh Kumar Sahu. 3. Both the parties have appeared before the Mediation Center of this High Court and as per the Mediation Report dated 17.12.2024, the parties have settled their dispute through mediation. Both the parties are seeking disposal of this appeal in terms of the compromise arrived at between them. The terms and conditions of the compromise deed (le>kSrk i=d) are reproduced below:- 1. आवेदक ्ቦी विवकास साहू का अवस्यक पु्ቔ भुवेष साहू जो व्ቔमान में 8 वष का है व व्ቔमान में अपने नानाजी के साथ ्ቇाम विदयाबा्ቔी, गुरूर, जिजला बालोद में विनवासर्ቔ है ्ቔथा डोण्ड़ी-द्ቤी, जिजला बालोद के स्वामी आत्मानंद इं቉ኌ-लश विमडिडयम हायर सेके न्ड्री स्कु ल में क्ቌा ्ቔीसरी मे अध्ययनर्ቔ है व बा቉ኌलग हो्ቔे ्ቔक अपने नानाजी के साथ ही विनवासर्ቔ रहेगा। 2. आवेदक ्ቦी विवकास साहू ्ቛारा अवस्यक पु्ቔ भुवेष सहू का संपू्ቓ शिश्ቌा- विद्ቌा का ख्ቊ जैसे स्कुृ ल फीस, जु्ቔे, स्कु ल युविनफाम ख्ቊ विप्ቔा ्ቛारा ही वहन विकया जाएगा। 3. अवयस्क भुवेष साहू के स्कु ल की गम>, सद>, होली, दशहरा एवं विदपावली की छु ्ሾीयो के दौरान आधी छु ्ሾीयॉ अपने विप्ቔाजी के साथ व आधी छु टटीयॉ अपने नानाजी के साथ पूरा करेगा। उभयप्ቌ इस समझौ्ቔा प्ቔ की श्ቔG से सहम्ቔ हैं एवं पालन के ቉ኌलए कविटब्ሾ हैं समझौ्ቔा प्ቔ में दी गई श्ቔG को उन्होंने अपनी स्वयं की स्वेच्छापूवक सहमडि्ቔ एवं विबना विकसी दबाव, भय एवं लाल्ቊ के स्वीकार विकया गया है। उभयप्ቌ ने इस समझौ्ቔा प्ቔ की श्ቔG को पढ़ने व समझने के प्ቐा्ቔ अपनी स्व्ቔं्ቔ सहमडि्ቔ से परस्पर एक- दूसरे की उपቝኌस्थडि्ቔ में हस््ቔा्ቌर कर विनष्पाविद्ቔ विकया। मध्यस्थ्ቔा कायवाही में आवेदक व अनावेदक के अडिधव्ሹा ्ቛारा सहयोग ्ቚदान विकया गया जिजसके ቉ኌलए धन्यवाद ्ሺाविप्ቔ विकया जा्ቔा है। विबलासपुर (छ.ग.) ्ቚथम प्ቌ… fodkl lkgw f}rh; प्ቌ ..pqjkeu yky lkgw e/;LFk Ckhuw 'kekZ 4. Having regard to the terms of compromise arrived at between the parties and since both the parties have decided to resolve their dispute, the present appeal is disposed of in terms of the settlement arrived at between the parties.
