Contd..2P… THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2694 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No. 206 of 2024, registered at Malikipuram Police Station, Dr. B.R. Ambedkar Konaseema District, for the alleged offences under Sections 406, 420, 468 read with Section 34 of the Indian Penal Code, 1860, based on the complaint filed by the 2nd respondent. The learned counsel further submits that in the complaint, the 2nd respondent alleged that the petitioner fabricated the two cheques belonging to him. It is submitted that the petitioner has been falsely implicated in this case and he has no role in the commission of the offence. 3. The learned Assistant Public Prosecutor appearing for the State submits that the case is at the investigation stage. 4. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioner, this Court deems it appropriate to dispose of the criminal petition by -2- CRL.P. No.2694 OF 2025 directing the Investigation Officer/ Station House Officer, Malikipuram Police Station, Dr.B.R.Ambedkar Konaseema District, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.206 of 2024. 6.
