Heard Mr. Amitav Tripathy, learned counsel appearing for the appellant-husband and Mr. Bibhuti Ranjan Mohanty, learned counsel appearing for the respondent-wife. 2. Being aggrieved with the judgement and order dated 2nd January, 2025 passed by the learned Judge, Family Court, Dhenkanal in C.P. No.127 of 2023, dismissing the application under Section 13(1) of the Hindu Marriage Act, 1955 preferred by the ap1pellant-husband, he preferred this appeal. 3. During pendency of this appeal, both the appellant- husband and respondent-wife desired to mutually annul their marriage and have filed a joint affidavit to that effect. Subsequent thereto, they field the motion petition by mutual consent before the Judge, Family Court, Dhenkanal. 3. In terms of the same, the learned Judge, Family Court, Dhenkanal on 07.01.2026 in C.P. No. 188 of 2025 passed a judgment dated 07.01.2026 under Section 13(b) of the Hindu Marriage Act, dissolving the said marriage dated 23.01.2022 by passing a decree of divorce. Accordingly, certificate copy of the judgment dated 07.01.2026 passed by the learned Judge, Family Court, Dhenkanal in C.P. No.188 of 2025 preferred by both the appellant and respondent as petitioners under Section 13(b) of the Hindu Marriage Act is placed before this Court. 4. We have perused the same. 5. In view of the said judgment and decree dated 07.01.2026 passed by learned Judge, Family Court, Dhenkanal preferred by both appellant and the respondent, this appeal being infructuous, stands disposed of. 6. Copy of the judgment dated 07.01.2026 passed by the learned Judge, Family Court, Dhenaknal in C.P. No.188 of 2025 be kept as a part of the record. 7. Pursuant to the judgment and decree dated 07.01.2026 passed by the learned Judge, Family Court, Dhenkanal in C.P. No.188 of 2025, the amount of Rs.12,00,000/- (Rupees Twelve Lakhs) deposited before the Registrar Judicial of this High Court by two different Demand Drafts bearing No.797249 amounting to Rs.5,00,000/- (Rupees Five Lakhs) dated 03.12.2025 and Demand Draft No.797248 dated 02.12.2025 drawn in Bank of India amounting to Rs.7,00,000/-) (Rupees Seven Lakhs) shall be paid to the respondent-wife, Krishna Mishra by the Registrar Judicial being duly identified by her counsel, obtaining necessary acknowledgement from her in that regard. 8. Copy of this order shall be sent to the learned Judge, Family Court, Dhenkanal to keep on the record of C.P. No.127 of 2023. 9. With the above observations, this appeal stands disposed of.
