The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 25(1-B)(a) of the Arms Act. 3. The case of the prosecution in short is that from the daalan of this petitioner one country made pistol has been recovered. 4. Learned counsel for the petitioner has submitted that the daalan is an open place and nothing has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner has further submitted that the police has not complied Section 105 of the BNSS and the witnesses of the seizure list are police personnel. No.86529 of 2025(2) dt.18-12-2025 2/2 petitioner has further submitted that the petitioner is a man of clean antecedent and is in judicial custody since 16.09.2025. 5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Salimpur P.S. Case No. 262 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Barh, Patna. durgesh/- (Ashok Kumar Pandey, J) U T
