Heard Sri Deepak Kashinath Dubey, learned counsel for the petitioner and Sri Dinesh Kumar Tiwari, learned Standing Counsel for the State. 2. The instant petition has been filed for the following reliefs:- "(a) Issue a writ, order or direction in the nature of MANDAMUS directing and commanding the respondent no. 2 to decide the application dated 21.12.2023 for fixation of boundary marks on the final order dated 18.12.2023 passed by the respondent no.2. (b) Issue any other writ, order or direction in the nature as this Hon'ble Court may deem fit and proper in the circumstances of the case. (c) Allow the writ petition with costs in favour of the petitioner". 3. Learned counsel for the petitioner submitted that against the order dated 18.12.2023 passed under Section 24 of the U.P. Revenue Code, 2006, appeal under Section 24(4) of the U.P. Revenue Code, 2006 has been filed by private respondent, which is pending before the appellate Court, as such the instant petition has been become infructous. 4. In view of the statement made by the learned counsel for the petitioner, the instant writ petition is dismissed as infructous.
