Hon'ble Prakash Padia,J. 1.Recovery notice dated 13.12.2024 issued by the respondent no.3- District Magistrate, Jaunpur against the petitioner is under challenge in the present writ petition. 2. It is stated by the learned counsel for the petitioner in para no. 15 of the writ petition that aforesaid recovery notice has been issued against the petitioner without providing an opportunity of hearing. This fact is also clear from the perusal of record. It is further argued that it is settled law that no recovery notice can be issued without providing an opportunity of hearing to the parties concerned, hence, prayer has been made that present writ petition may be allowed and impugned recovery is liable to be set aside. 3. Heard learned counsel for the parties and perused the record. 4. In this view of facts and also in the interest of justice, the impugned recovery notice dated 13.12.2024 issued by the respondent no.3-District Magistrate, Jaunpur is hereby set aside. It is made clear that passing of this order will not restrain the respondents to initiate fresh proceeding against the petitioner. 5. With the aforesaid observations, the writ petition is allowed.
