AMARNATH GOUD ORDER 10.07.2025 [1] Heard learned counsel for the respective parties. [2] This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “(i) Issue Rule upon the respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/direction of like nature shall not be issued for directing the respondents to do the needful for releasing /disbursing the Pension of the petitioner as dependent of deceased Freedom Fighter under “Swatantra Sainik Samman Pension Scheme” with entitled arrear plus interest for deferred payment. (ii) Make the rules absolute. (iii) Call for records..” [3] It is seen from the record that a communication dated 22.05.2025 has been made by the Sr. Accounts Officer (Legal Cell, CPAO) addressed to the Under Secretary, Freedom Fighters Division, Ministry of Home Affairs, NDCC–II Building, 2nd Floor, Jai Singh Road, New Delhi-110001 in connection with the legal notice received from the petitioner’s engaged counsel for releasing/disbursing of the family pension under “Swatantra Sainik Samman Pension Scheme” but the same is pending for adjudication. [4] In view of the same, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the respondent Nos. 1 and 2 to consider the case of the petitioner in light of the communication dated 22.05.2025 as expeditiously as possible in accordance with law. The petitioner is at liberty to place any other information as required by the respondents in support of their claim. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
