KOTTI SIVA Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A4, seeking regular bail, in Crime No.151 of 2024 of Ravikamatham Police Station, Anakapalli District. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short [the NDPS Act'). -I `-` -- ``--_ 2 3. The brief facts 6'fthe case are that on o1.08.2024, upon recel'ving credible information about the illegal possession and transportation of ganja, the Sub-Inspector of police, along with his staff and mediators, rushed to outskirts of Kowagunta Village, Ravikamatham MandaI, AnakapaIIi District, and conducted vehicle checking. They found one EECO Star Passenger Van bearing No.AP-39-LG-9295, containing 96 kgs ganja, and seized the ganja and the vehicle from A2. The contraband, along with other materials, was seized under the cover of mediator's report. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that, based on the confessions of co-accused, the case was registered against the petitioner/A4. Upon reviewing the remand report of A4, it indicates that the crime was registered against the petitioner solely based on the confession statements of co-accused, and no contraband was seized from the petitioner. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is n'ot complete. when ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no previous antecedents under the NDPS Act. The learned counsel for the petl-tigne=r submits that the petitioner -` 6. ln view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused No.4 basing on the confessional statement of co-accused and no contraband was seized from him, this Court is of the opinion that the release of the present petitioner would not hinder the investigation in anyway. The petitioner has been judicial custody since 24.01.2025. Most of the witnesses are shown to be official witnesses and the release of the petitioner/A4 would not cause hampering of investigation, this Court is inclined to grant bail to the petitioner herein/A4, on the following conditions: (i) The petitioner/A4 shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge-cum-Special Judge for Trial of Offences Under NDPS Act, Visakhapatnam.
