The present 482 Cr.P.C. application has been filed seeking a direction to Additional District & Sessions Judge, Kanpur Nagar to decide Special Sessions Trial No.502 of 2017, State vs. Shivam Singh, arising out of case crime no.117 of 2017, under Sections 307, 323, 504, 506, 147, 149 and 336 I.P.C., P.S. Panaki, District Kanpur Nagar within stipulated period. After framing of charge P.W.1 and P.W.2 have been examined but thereafter they did not appear in the trial proceedings. The trial is being delayed. On account of delay in disposal of the case by the trial court is causing serious prejudice resulting in miscarriage of justice to the applicant. Considering over all circumstances of the case, the present application is disposed of with a direction to the trial court concerned to decide the aforesaid Session Trial within a period of one year, from the date of production of a certified copy of this order before him, if there is no legal impediment.
