No.37409 of 2025 effect from the date as may be determined by this Hon'ble Court and to revise their pay and pension accordingly and grant the petitioners them all service and monetary benefits including the consequential arrears therefor within a time frame. For petitioners : Mr.S. Selva Thirumurugan For Respondents : Mr.V. Jeevagiridharan Addl.Govt. Pleader for RR 1&2 Mr.V. Vijay Shankar Standing Counsel for R3 ORDER Mr.V. Jeevagiridharan, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.V. Vijay Shankar, learned Standing Counsel takes notice for the 3rd respondent. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself. 2. It is stated by the petitioners that they were fully qualified and eligible to be promoted to the post of Assistant Executive Engineer (A&E) during the years 2022–2023, 2023–2024, and 2024–2025, well before their superannuation. However, due to the delay in finalising the promotion panels for the said years, they were not considered for promotion, despite availability of vacancies. The grievance of the petitioners is that though they were otherwise eligible for promotion to the said post, panels for the relevant years were prepared belatedly on 20.06.2025 and approved only after their superannuation, 2/6 https://www.mhc.tn.gov.in/judis W.P. No.37409 of 2025 owing to which they were deprived of their promotion. The petitioners, therefore, sought revision of the promotion panels for the said years and inclusion of their names therein, notionally with effect from the appropriate dates, so as to revise their pay and pension accordingly and to extend all consequential service and monetary benefits, including arrears by submitting representations on various dates to the respondents, which evoked no response. Hence, they filed this writ petition with the aforesaid prayer. 3. Learned counsel for the petitioners submitted that the issue involved in this writ petition is squarely covered by the decision of this Court in T.S. Ramalingam vs. Government of Tamil Nadu, rep. by its Secretary and another reported in 2020 SCC OnLine MAD 21773, wherein it was held that eligible officers who were denied promotion due to administrative delay are entitled to notional promotion for the relevant period. Hence, it is prayed that suitable directions may be issued to the respondents to consider the case of the petitioners for inclusion of their names in the promotion panels for the years 2022-2023, 2023-2024 and 2024-2025, notionally, and to revise their pension and other attendant benefits accordingly, within a time frame to be stipulated by this Court. 3/6 https://www.mhc.tn.gov.in/judis W.P. No.37409 of 2025 4. Acceding to the aforesaid submission, learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the 1st respondent may be directed to consider the petitioners' representations, within a stipulated time to be fixed by this Court. 5. In view of the fair submission made by the learned Additional Government Pleader, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioners' representations submitted on various dates with regard to inclusion of their names in the promotion panel for the relevant period and other consequential benefits to them notionally, on their own merits and pass orders in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. 6. With the above directions, this writ petition stands disposed of. No costs. 07.10.2025 (1/2) Index:Yes/No Speaking/Non-speaking order Neutral Citation : Yes/No vsi2 4/6 https://www.mhc.tn.gov.in/judis W.P. No.37409 of 2025 To 1.
