Neutral Citation No. - 2025:AHC:128192 Court No. - 35 Case :- WRIT - C No. - 37561 of 2024 Petitioner :- Rajkishor Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Alka Srivastava Counsel for Respondent :- C.S.C.,Sunil Kumar Singh Hon'ble Syed Qamar Hasan Rizvi,J. 1. Heard Sri P.K. Ganguli, Advocate holding brief of Ms. Alka Srivastava, learned counsel for the petitioner; Sri Nand Lal Maurya, learned Standing Counsel for the State-respondent nos.1 to 3 and Sri Rohit Yadav, Advocate holding brief of Sri Sunil Kumar Singh, learned counsel for the Land Management Committee. 2. By means of the present writ petition, the petitioner has assailed the order dated 03.10.2024 passed by the Additional Commissioner Administration-Ist, Meerut Division (respondent no.2) in Case No.909 of 2024 under Section 210 of the U.P. Revenue Code, 2006. 3. Submission of the learned counsel for the petitioner is that the Revisional Court without looking into the nature of impugned order dated 19.03.2024 dismissed the said revision as not being maintainable. He further submits that Section 67(6) of the U.P. Revenue Code, 2006 clearly provides that notwithstanding anything contained in any other provision of this Code, and subject to the provisions of this section every order of the Assistant Collector under this Section, shall, subject to the provisions of sub-section (5) be final. At the same time, Section 67(5) provides that any person aggrieved by an order of the Assistant Collector under sub-section (3) or sub-section (4), may within thirty days from the date of such order, prefer an Appeal to the Collector. 4. It is contended by the learned counsel for the petitioner that the nature of the impugned order dated 19.03.2024 passed by the Tehsildar/Assistant Collector, Baghpat, is such that the same does not fall within the ambit of the orders to be passed under Sub Section (3) or (4) of Section 67 of the U.P. Revenue Code, 2006, as such, the provisions of Section 67(6) of the Code would not be applicable, therefore the order dated 19.03.2024 is not appealable before the Collector under Section 67(5) of the U.P. Revenue Code, 2006, thus the petitioner rightly preferred the revision under Section 210 of the Code, but the learned Revisional Court in an arbitrary manner passed the impugned order dated 03.10.2024 without looking into the provisions of law in correct perspective. 5. 5. The order dated 19.03.2024 passed by the Tehsildar concerned in the proceedings under Section 67 of the U.P. Revenue Code, 2006, is reproduced as under: "पतत्रावलली प्रस्ततुत। 6. Learned Standing Counsel appearing on behalf of the State opposed the writ petition and submitted that the order dated 19.03.2024 passed by the Tehsildar is appealable as per Section 67(5) of the U.P. Revenue Code, 2006 before the Collector and learned Revisional Court has rightly dismissed the said revision as not maintainable. 7. The order dated 03.10.2024 passed by the Additional Commissioner, Administration-Ist, Meerut Division (respondent no.2) is reproduced as under: "यह बनगरत्रानली रत्राजबकशिजर पतुत श्यत्रामलत्राल बनवत्रासली गत्राम टयजढली परगनत्रा ककौतत्रानत्रा , तहसलील व तजलत्रा बित्रागपत ककी ओर सने तह सलीलदत्रार बित्रागपत दत्रारत्रा यत्रासंद ससंख्यत्रा 3499/2022 कम्प्यपूटरलीकक त बित्राद ससंख्यत्रा टली202211080103499/2022 भपूबम प्रबिन्धक सबमबत बिनत्राम रत्राजबकशिजर अन्तगर्तात धत्रारत्रा -67 उ०प्र० रत्राजस्व ससंबहतत्रा 2006 मम पत्राररत आदनेशि बदनत्रासंक 19-03-2024 कने बवरुद्ध यजतजत ककी गयली हहै। 8. From a bare perusal of the order dated 19.03.2024 it is evident that by means of the said order, the petitioner was directed to provide certain documents relating to the 'category' of the land on which the house in question has been constructed and also the Gata number of the same and the Tehsildar/Assistant Collector fixed 02.04.2024 for further hearing. 9. Taking into consideration the nature of the aforesaid order dated 19.03.2024 as quoted herein above, this Court is of the view that the same did not cause any such prejudice to the petitioner warranting him to challenge the same before the higher Court. 10. In view of above, the present writ petition can be disposed of at the admission stage itself without calling for counter affidavit, by granting liberty to the petitioner to appear before the Court of Tehsildar (Judicial), Baghpat (respondent no.3) by filing a detailed reply/objection(s) afresh and to raise all his pleas before the court concerned in the proceedings of the Case No.3499 of 2022 . 11. It is provided that in case the petitioner submits his reply/objection(s) in the aforesaid proceedings, the Tehsildar concerned after taking into consideration the reply/objection(s) raised therein, shall pass appropriate orders on the same as expeditiously as possible. 12. With the aforesaid observations and directions, the present writ petition is disposed of.
