AND P.S. TANGLA, DIST. UDALGURI, BTR, ASSAM, PIN- 784521. VERSUS THE UNIVERSITY GRANTS COMMISSION (UGC) AND 2 ORS. TO BE REPRESENTED BY ITS CHAIRMAN, BAHADUR SHAH ZAFAR MARG, NEW DELHI. 2:THE PRINCIPAL OF THE B. BARUAH COLLEGE RG BARUA ROAD ULUBARI GUWAHATI-7. 3:THE DEPUTY COMMISSIONER UDALGURI ASSA Advocate for the Petitioner : MR. A M BARBHUIYA, MR. B SAHARIA,MS A BEGUM Advocate for the Respondent : GA, ASSAM, MS P AGARWAL (r-1),SC, U G C BEFORE HONOURABLE MR. JUSTICE MICHAEL ZOTHANKHUMA ORDER 08.04.2025 1. Heard Mr. B. Saharia, learned counsel for the petitioner, who submits that Page No.# 2/3 the petitioner is a B.A. student of B. Boorah College, Guwahati for the session 2023 – 2024. The petitioner’s grievance is that though the petitioner had applied for grant of Scholarship under the Ishan Uday Special Scholarship Scheme for the North Eastern Region under the University Grant Commission (UGC), New Delhi, the petitioner has not been given the benefits of the said Scholarship Scheme till date. 2. Dr. P. Agarwal, learned counsel for the UGC submits that the UGC have not received any application from the petitioner, for grant of Scholarship under the Ishan Uday Special Scholarship Scheme for the North Eastern Region. She submits that upon inquiry, the UGC have come to learn that the petitioner had applied for a Post Matric Scholarship that is to be granted to OBC students of Assam from the National Scholarship Portal 2.0, which is not under the UGC. 3. The submissions made by the counsels for the parties clearly show that there are disputed questions of facts, which requires the recording of evidence. The issue is as to whether the petitioner had applied for a Scholarship under the Ishan Uday Special Scholarship Scheme for the North Eastern Region under the University Grant Commission (UGC), New Delhi or for a Post Matric Scholarship that is to be granted to OBC students of Assam from the National Scholarship Portal 2.0. 4. In view of the above fact, this Court is not inclined to proceed with the present case any further, as this Court is ill equipped to decide the issue. The writ petition is accordingly dismissed, with liberty being given to the petitioner, Page No.# 3/3 to approach the Civil Court with her grievance, if so advised. JUDGE Comparing Assistant
