The Writ Petition is filed questioning the inaction of the respondents in withholding the payment of bills First and Final Bill Gross amount of Rs.4,96,550/- in Net amount of Rs.4,38,157/- even after finalizing the bills payable to the Petitioner in relation to the work i.e. Providing CC road from Pole No.18/78-A-1 to Ple No.18/71-A in NGO Colony in Ward No.20 in Rayachoty Municipality vide Agreement No.676/2023-24, dated 18.12.2023, as illegal and arbitrary. 2. Heard Sri Suresh Kumar Reddy Kalava, learned counsel for the Petitioner and Sri Gudapati Lakshmi Narayana, learned Standing Counsel for the Respondent No.3-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.3-Municipality passed on written instructions received by him, signed by the Commissioner, Rayachoty Municipality, wherein Paragraph No.4 reveals that the Writ Petitioner had executed the work as stipulated under agreement referred above. It is further submitted that the payment could not be made due to lack of funds and the financial priority of the Respondent-Municipality is not in good position to pay the amounts from the Municipal General Funds. It was stated that the Municipality will be paying the amounts as and when the amounts are released under GGMP-HIW Grant, without any delay. 3 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides and by placing the written instructions on record, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order.
