GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.5337 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the impugned action of the respondents 2 and 3 in not acting upon the complaint of the petitioner Dt.28-12-2018 and not taking proper action into the matter and not investigating into the offence committed by the accuses and thereby violating the fundamental rights of the petitioner as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents 2 and 3 to entrust investigation in Cr.No.269/2018 to some other officer for conducting effective investigation into the matter and grant such other just relief and pass…” 2. Learned Assistant Government Pleader for Home on written instructions would submit that police concluded detailed investigation in Crime No.269 of 2018, and on conclusion of the same, charge sheet was laid before the concerned Magistrate vide C.C.No.2123 of 2018 and the same is coming for trial. 3. Sri Srinivasa Rao Pappu, learned counsel for the petitioner would submit that in the above circumstances, the writ petition may be disposed of. 4. Considering the above facts and circumstances, this court is of the considered opinion is that the writ petition can be disposed of at the stage of admission, without going into merits of the case, as no further orders are required at this length of time, since charge sheet has been filed, and the case is also before the learned Magistrate. 4 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
