JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 18-12-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 316(5), 318(4) and 3(5) of the BNS. 3. The case of the prosecution in short is that the official members of Pinjari Pax have been accused of embezzling government fund on a large scale and upon inspection it was found that they have embezzled altogether Rs.1,54,25,794/- of the government fund. 4. Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that there are 11 accused persons. It has further been submitted that the name of this petitioner finds place on 11th Number. It has further been Patna High Court CR. MISC. No.86518 of 2025(2) dt.18-12-2025 2/2 submitted that the nature of allegation is general and omnibus and there is no specific allegation against this petitioner as to what have been embezzled by him. It has further been submitted the President of Pax Committee has given undertaking in Cr. Misc. No. 81995 of 2025 that she will deposit the entire amount. 5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barbigha P.S. Case No. 167 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura. durgesh/- (Ashok Kumar Pandey, J) U T
