02/24.04.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bhartiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in a criminal case registered for the offences punishable under section 379 of the Indian Penal Code, in connection with Dhanbad GRPS Case No. 162 of 2024, pending in Railway Court, Dhanbad.

Heard the learned counsel for the petitioner and the learned counsel for the State.

The learned APP opposes prayer for anticipatory bail of the petitioner.

The allegation against the petitioner is that he has committed theft of the purse of the wife of the informant having two mobile phones at Dhanbad railway station.

Learned counsel for the petitioner submits that petitioner is not named in the FIR. He further submits that the mobile phone which was found from the possession of the petitioner has been purchased by him and he was unaware of the fact that the same is stolen one. Counsel submits that notice under section 35(3) of BNSS has been served upon him, which he had complied with. The petitioner went to the police station and handed over the mobile phone to the I.O. and has also cooperated with the investigation.

Considering the submissions of the counsel for the petitioner and the facts that the petitioner has cooperated with the investigation and has handed

over the mobile phone also to the I.O., I am of the opinion that there is no threat of arrest of the petitioner.
7. Hence, the petitioner is directed to appear before the trial court and on his appearance the learned trial court shall consider his case as per law.
8. Hence, the present anticipatory bail application is disposed of.
