Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Case No. 820 of 2022, titled Smt. Gunjan Agarwal Vs. Amit Agarwal and others, under Sections 17, 18, 19, 20, 21, 22 Protection of Women from Domestic Violence Act, 2005, Police Station Kotwali Hathras, District Hathras, pending before the Civil Judge (J.D.), FTC-IInd, Hathras to any other district. Applicant being husband is resident of Mumbai, who seeks transfer of the above case pending at Hathras to any other district on the ground that the brother of opposite party no.2 is a practicing advocate at Hathras. When the case is called, no one has appeared on behalf of applicant. Learned A.G.A. is present. At this stage, Mr. Sudhir Mehrotra, learned counsel for opposite party no.2 has drawn the attention of the Court to the zimni orders passed by the trial court and pointed out that on majority of the occasions, the applicant and others are seeking exemption from personal appearance. He further submits that this Court vide order dated 15.4.2024 has already expedited the proceedings to be concluded preferably within six months, but the applicant and others are trying to delay the adjudication. Upon considering the above background, this Court finds that merely because the brother of opposite party no.2 is a practicing advocate at Hathras, it would not be a sufficient ground for transfer of the case. A reading of the zimni orders shows that the trial court is frequently extending the exemption from personal appearance to the applicant, therefore, in this background, no case is made out for transfer of the case.
