Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Case No. 26196 of 2023, titled State Vs. Akshay Kumar and others, arising out of Case Crime No. 132 of 2023, under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Nauchandi, District Meerut, pending before the Additional Chief Judicial Magistrate-I, Meerut to the court of competent jurisdiction at Hapur. When the case is taken up, no one has appeared on behalf of applicant. Learned A.G.A. is present. As per the averments contained in the application, above case was lodged by the applicant when she was residing at Meerut, but later she has shifted to Hapur, and now it is difficult for her to travel from Hapur to Meerut to pursue the said case. That apart, it is pleaded that whenever she goes to Meerut, the opposite party nos.2 to 4 are threatening her. The case is pending since 2023 and the averments of thereats by opposite party nos.2 to 4 are vague and are not supported with any material, much less any complaint in this regard to any authority. The distance between two towns is only 40 kilometers and the case was lodged by the complainant-applicant herself at Meerut, therefore, no case is made out for transfer of the case as her interest is protected by State. The application fails and is hereby dismissed.
