r Petition under Sections 482 of BNSS (old 438 of Cr.P.C), praying that in Wv the circumstances stated in the affidavit filed in support of the Criminal W Petition, the High Court may be pleased to enlarge the Petitioners/Accused 1 to 5, 7, 8 on bail in the event of their arrest in connection with Cr.No.1 of 2025 on the file of Gudur Police Station, Kurnool District. The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri CHANDRA SEKHAR REDDY, Advocate for the Petitioners and of PUBLIC PROSECUTOR for the Respondent and the Court made the following;
HON’BLE SRI JUSTICE K. SREENIVASA REDDY Criminal Petition No.2624 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners herein/A1 to A5, A7 and A8, seeking anticipatory bail, in connection with Crime No.1 of 2025 of Gudur Police Station, Kurnool district. A case has been registered against the petitioners herein and another for the offence punishable under Section 118(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.
During the course of investigation, police altered the section of law from 118(1) to 118(2) of the BNS. Case of the prosecution, in brief, is that on 31.12.2024, at about 09.30 PM, at Fish Andhra Shop, near Rice Mill, Yemmiganur Road, Gudur town, the accused attempted to affix year banner, but the de facto complainant and his uncle Srinivasulu objected, which led to an altercation between them, wherein the accused are alleged to have assaulted the de facto complainant with stones and sticks and caused bleeding injuries. 5. A perusal of the material on record goes to show that on the date of alleged incident, a quarrel ensued between the de facto complainant and the accused. In respect of that, petitioners 2 and 4 herein/A2 and A4 are alleged to have threatened the de facto complainant. Thereupon, they, along with all other accused, are alleged to have attacked the de facto complainant and caused bleeding injuries on his forehead and nose and swelling injury on his left hand. 6. Since specific overt acts have been attributed against the petitioners 2 and 4 herein/A2 and A4, this Court is not inclined to grant anticipatory bail to them. Accordingly, the Criminal Petition in respect of petitioners 2 and 4 herein/A2 and A4 is hereby dismissed. 7. Insofar as petitioners 1, 3 and 5 to 7/A1, A3, A5, A7 and A8 are concerned, except making an omnibus accusation against them that they are alleged to have attacked the de facto complainant, no specific overt act has been attributed against In view of the same, this Court is inclined to grant anticipatory bail to the petitioners 1, 3 and 5 to 7/A1, A3, A5, AT and A8 on the following conditions, i) In the event of arrest of the petitioners 1, 3 and 5 to 7/A1, A3, A5, AT and A8 in the aforesaid crime, they shall be them. 7 3 enlarged on bail on their executing personal bond Rs. 10,000/- (Rupees Ten Thousand only) each with of the like sum each to the satisfaction Arresting Officer.
