Applicant-Appellant, namely, Ravindra Nishad has applied for suspension of sentence during pendency of the appeal, arising against the judgment of conviction dated 24.07.2023 and order of sentence dated 26.07.2023 passed by Additional District and Sessions Judge, Court No.12, Gorakhpur in Sessions Trial No. 335 of 2018 arising out of Case Crime No.175 of 20188, thereby convicting the appellant under Sections 304 Part II I.P.C., followed by imposition of sentence of seven years, under Section 304 Part II I.P.C. with fine of Rs. 10,000, with a further condition that in the event of non deposit of fine, convict shall undergo further imprisonment of fifty days. Learned counsel for the applicant states that the appeal was admitted on 09.01.2025 and the sentence of seven years imposed upon the applicant/ convict has been served by him, as the applicant has been released from prison on 26.1.2025. In this regard, learned counsel has referred to the communication of Superintendent, District Jail, Gorakhpur dated 5.4.2025 and states that the present appeal has been rendered infructuous. Dismissed as infructuous.
