By means of the present criminal writ petition, petitioner has challenged the FIR No.281 of 2021 dated 05.09.2021 registered with P.S. Sitarganj, District Udham Singh Nagar, under Sections 332, 353 and 504 of IPC. 4. It is informed by the learned State Counsel that after investigation, charge-sheet has already been submitted by the police on 06.12.2021 against the petitioner, therefore, nothing remains to be decided in this writ petition and it becomes infructuous. 5. The said fact is not disputed by learned counsel for the petitioner. 6. In view of the above, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioner to challenge the charge- sheet in appropriate proceedings, before the appropriate forum. 7. Interim order dated 29.10.2021 stands vacated.
