Petitioner has been made an accused in connection with Kadma P.S. Case No. 106 of 2021, Corresponding to G. R. Case No. 1998/2021 registered under Sections 406, 420, 504 and 506 of the Indian Penal Code, pending in the court of learned S.D.J.M., Jamshedpur. Bail was granted to the petitioner by this court vide B.A. No. 15094 of 2021 by order dated 24.03.2022. It is alleged that the informant had entered into contract for development of her land with this petitioner. It was agreed that petitioner will hand over two flats and two parking lots to the informant. However, petitioner subsequently refused to honour the agreement. Supplementary affidavit was filed on behalf of the petitioner that he will be handing over two flats and two parking lots to the informant as per the agreement but at different location. However, the commitment made by the petitioner was not honored. It appears that the on the basis of commitment made by the petitioner he was granted bail, instead of honouring the commitment made before this court, the petitioner chose to surrender before the learned court below and thereafter he has come again with a prayer for grant of bail. Regard being had to the facts and circumstance of the case and considering the nature of the allegation and the fact that the petitioner has filed a false affidavit before this Court; I am not inclined to enlarge the petitioner on bail.
