The matter is amicably settled between the parties. The claimants, herein, and the respondents United India Insurance Company Limited, represented by Mr. Swapan Maji, RM, are present before the Court today. It is stated by the claimants No. 2 & 3 that the claimed amount now receivable by them, be paid to the claimant No. 1, their mother. It is submitted by both the claimants and the Insurance Company’s representatives that this matter is settled between the parties at an amount of Rs. 53,28,050/-. Page No.# 3/4 It is to be noted that the Insurance Company had already deposited an amount of Rs. 28,28,050/- with the Registry of this Court. In terms of the order passed by the Court in the connected interlocutory application being IA(c)3711/2023, out of the said amount of Rs. 28,28,050/-; an amount of Rs. 15,00,000/-, has already been released to all the claimants, herein. The Insurance Company will now deposit the balance amount of Rs. 25,00,000/- within a period of 45 days from today before the Registry of the Gauhati High Court, Guwahati. Failure to deposit the above-noted amount within the stipulated time by the Insurance Company, the above amount would carry an interest @ 7% from the date of filing of the claim petition before the learned Tribunal. Accordingly, the balance amount of Rs. 13,28,050/-[after withdrawal of Rs. 15,00,000/- by all the claimants, herein, out of Rs. 28,28,050/-] along with the deposited amount of Rs. 25,00,000/- shall be released to the claimant No. 1 viz. Rina Devi. Out of the total amount of Rs. 38,28,050/- now required to be released to the claimant No. 1 viz. Rina Devi; an amount of Rs. 10,00,000/- be released and kept in the Fixed Deposit Account in the name of claimant No. 1 viz. Rina Devi, with a nationalized Bank/Post Office in a Monthly Income Scheme, with nomination facility. The remaining amount of Rs. 28,28,050/- be released to the claimant No. 1 viz. Rina Devi, by the Registry of the Gauhati High Court, Guwahati, upon furnishing of adequate documents for her identification as well as the particulars of her Bank Account. Page No.# 4/4 Statutory Deposit, if any, made by the Insurance Company being not a part of the amount so settled today; the same be released to the Insurance Company on an application made by it in this connection. The appeal, accordingly, stands disposed of in terms of the amicable settlement reached between the parties. The compromise format signed by the parties is kept on record.
