(2) Petitioner participated in a selection for the post of Work Shop Instructor (Fitter) held by Uttarakhand Subordinate Service Selection Commission. Learned Counsel for the petitioner submits that name of one of the candidates, who was recommended by the selecting body for appointment, has been recalled, as it was later found that her name was included in the list of recommended candidates by mistake. Thus petitioner contends that since his name figures immediately below the last selected candidate, therefore, his name should be recommended for appointment. (3) Mr. B.D. Pande, learned Counsel appearing for the selecting body, assures the Court that Commission will examine the matter and if it is found that petitioner is immediately below the last selected candidate, then needful shall be done as per law. (4) Accordingly, writ petition is disposed of with liberty to the petitioner to make a representation to the Secretary of the selecting body. If he makes representation within one week from today, the selecting body shall look into the matter and pass appropriate order, as per law, within three weeks thereafter.
