Mr. Bhuwnesh Joshi, learned counsel for petitioner. 2. Mr. K.S. Bohra, learned D.A.G. with Mr. J.P. Kandpal, learned Brief Holder for the State of Uttarakhand/ respondent Nos.1 to 3. 3. By means of the present criminal writ petition, petitioner has challenged the FIR No.586 of 2021 dated 30.09.2021 registered with P.S. Jwalapur, District Haridwar, under Sections 376, 511, 506 of IPC and under Sections 3(1)(w)(i) and 3(1)(w)(ii) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (amended in 2015). 4. It is informed by the learned State Counsel that after investigation, charge-sheet has already been submitted by the police on 16.07.2022 against the petitioner, therefore, nothing remains to be decided in this writ petition and it becomes infructuous. 5. Learned counsel for the petitioner has not disputed the said fact. 6. In view of the above, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioner to challenge the charge- sheet in appropriate proceedings, before the appropriate forum. 7. Pending application, if any, also stands disposed of.
