HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE
ORDER 10.11.2025
1. The instant contempt petition arises out of an order dated 02.02.2021 passed in WP(C) No. 44/2021, by virtue of which the writ petition was disposed of with a direction to the respondent No. 2 to clear the admitted liability towards the petitioner expeditiously, preferably within a period of two months from the date copy of the order was made available to the said respondents. Since the aforesaid order was not complied with, within the time granted by this court, the instant contempt petition was preferred in which notice was issued way back on 03.05.2021.
2. The respondents have filed compliance report on behalf of respondent No. 2, on 02.09.2025. In the compliance report, a specific stand has been taken that the Managing Director, Kashmir Power Distribution Corporation Ltd., vide their
order bearing No. MD/KPDCL/345 of 2025 dated 27.08.2025
has released an amount of Rs. 8,72,000/- (Rupees Eight lacs Seventy two thousand) in favour of Executive Engineer, Electric Division-Anantnag for its onward disbursement to the petitioner.
3. Mr. Faheem Nissar Shah, learned GA appearing on behalf of the respondents, further submits that pursuant thereto an amount of Rs. 8,37,120/- (Rupees Eight lacs Thirty Seven thousand One hundred twenty) has been released in favour of the petitioner after deduction of GST. Accordingly, the
order passed by this court, in respect of which the instant contempt petition has been filed, stands complied with in its letter and spirit.
4. Thus, in the light of the stand taken by the respondents and also in the light of the statement made by Mr. Faheem Nissar Shah, learned GA at the Bar, no fruitful purpose would be served in keeping this contempt petition pending as the order passed by this court mentioned supra stands complied with.
5. Accordingly, the proceedings in the contempt petition stand closed.
6. Rule, if any, shall stand discharged.
