JUSTICE ALOK KUMAR SINHA ORAL ORDER 8 15-12-2025 Heard learned Senior Counsel on behalf of the Patna High Court CWJC No.6332 of 2018(8) dt.15-12-2025 2/6 petitioners and learned counsel on behalf of respondents-State. 2. In the present writ application the petitioner has prayed for the grant of following reliefs: “(i) For issuance of an order, direction or writ including writ in the nature of Certiorari quashing the order dated 12.9.2017 passed by the District Appellate Authority West Champaran, Betiah in case no 04 of 2017wherein the appeal has been rejected on the ground of limitation. (ii) For issuance of an order direction or writ including writ in the nature of Certiorari quashing the order dated 7.2.2018 passed by the State Appellate Authority in Appeal no 709 of 2017.where in the order of the district appellate authority has been affirmed. (iii) For issuance of an order, direction or writ including writ in the nature of Mandamus commanding the respondent District Appellate Authority West Champaran, Betiah to consider the case of the Petitioner on merit. (iv) For issuance of an appropriate declaration holding that it is a fit case for condonation of delay and consideration of the matter on merits. (v) For any other relief(s) to which the petitioner may be found entitled in Patna High Court CWJC No.6332 of 2018(8) dt.15-12-2025 3/6 the facts and circumstances of the present case.” 3. The crux of the matter is that the petitioners ought to have approached the District Teachers Appellate Authority within thirty days from the date the cause of action had arisen, but he approached the District Appellate Authority after almost seven years. It is on this account that the District Teachers Appellate Authority, West Champaran, Bettiah passed the order dated 12.09.2017 dismissing the appeal on the ground of being barred by limitation. The aforesaid order passed by the District Teachers Patna High Court CWJC No.6332 of 2018(8) dt.15-12-2025 5/6 Appellate Authority has been subsequently affirmed by the State Appellate Authority vide order dated 07.02.2018 passed in Appeal No.709 of 2017. 5. Learned Senior Counsel appearing for the petitioners admitted to the fact that the petitioners had approached the District Teachers Appellate Authority, West Champaran, Bettiah after inordinate delay, but his submission is that the impugned orders may be quashed and the matter be remanded back for decision on merit. 6. Learned counsel appearing for respondents-State opposes the prayer made by learned Senior Counsel appearing for the petitioners and submits that the petitioners had ample opportunity to file the case within the time prescribed by law, but instead of doing that he approached the District Teachers Appellate Authority, West Champaran, Bettiah after inordinate delay of seven years for which no reasonable explanation was offered/tendered before the District Teachers Appellate Authority. He, therefore, defends both the orders passed by the District Teachers Appellate Authority as well as the State Appellate Authority and submits that the present writ application is misconceived and therefore it should be dismissed. After having heard the submissions made by the parties, this Court is of the view that the order passed by the District Teachers Appellate Authority dated 12.09.2017 in Case No.04 of 2017 is a well reasoned and speaking order and the finding arrived at by the District Teachers Appellate Authority is in accordance with law. Learned Senior Counsel appearing for the petitioners has been unable to dislodge the reasoning and the finding given by the District Teachers Appellate Authority, West Champaran, Bettiah. Consequently. The order of the State Appellate Authority upholding the order of the District Appellate Authority is also proper in law. 8. For these reasons, I do not find any merit in the present writ application and I am not inclined to interfere with the impugned orders, hence the writ application is dismissed.
