Rejoinder affidavit filed today is taken on record. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for following substantial reliefs: "i) issue a writ, order or direction in the mandamus commanding and directing the respondents authority to provide the proper duty to the petitioner as per rules and also given the honorarium time to time including last three months. ii) issue a writ, order or direction in the mandamus commanding and directing the respondent No. 2/ District Magistrate, District Sant Kabir Nagar to decide the representation of petitioner dated 05.10.2024 within stipulated period which is pending before the respondent No. 2. (Annexure No. 1 to the writ petition)" 3. Shri Pankaj Kumar Gupta, learned counsel for respondent has obtained instructions according to which entire dues of the petitioner have been cleared, however, petitioner claims that he has not been allotted regular work. 4. In this regard petitioner may make a fresh representation within a period of two weeks from today and appropriate decision shall be passed within a further period of four weeks. 5. Shri Pankaj Kumar Gupta, learned counsel for respondents submits that petitioner has been served with the charge-sheet and enquiry is going on. 6. In the considered view of the Court, the aforesaid directions issued will not come in the way of the respondents in concluding the enquiry and petitioner is also directed to cooperate in the same. It is further provided that so long as the petitioner is discharging its duties which is allotted to him regularly, unless and until decision is taken adverse to him in the enquiry he shall continue to receive honorarium.
