Heard learned counsel for the appellants, learned A.G.A. for the State and perused the record. This application has been filed for quashing of the charge sheet dated 27.10.2023 as well as summoning order dated 06.03.2024 in S.S.T. No. 157 of 2024 arising out of case crime no. 163 of 2023, under sections 323, 504, 506 IPC and section 3(2)(5)Va of SC/ST Act, P.S. Bariyarpur, District Deoria pending before Special Judge (SC/ST Act), Deoria. On perusal of the record, the Court finds that the allegations made in the first information report disclose commission of a cognizable offence and those allegations have found support from the material collected during the course of investigation on the basis whereof the police has laid a charge sheet against the appellants.Therefore, prayer for quashing the chargesheet as well as cognizance order stand refused. At this stage, in case appellants appear before the court below within 30 days from today and apply for bail, the same shall be heard and disposed of in accordance with law. With the aforesaid observations, the application is disposed off.
